These terms are the agreement between you and its200 ("we," "us") covering your use of the its200 website, dashboard, monitoring service, and hosted status pages (together, the "Service"). By creating an account or using the Service, you agree to them. If you don't agree, don't use the Service.
The part people skip but shouldn't: its200 is a best-effort monitoring tool sold for a few dollars a month. It comes with no uptime guarantee, and our total liability to you is capped at what you paid us in the last month — which is $0 on the free plan. Details in no warranties and limitation of liability below.
## who we are
its200 is operated as a sole proprietorship based in the State of Ohio, United States. The owner's full legal name and mailing address are available on request — email support@its200.comand we'll send them. If the business is later incorporated, the entity will assume these terms and we'll note the change here.
## the service
its200 makes periodic HTTPS requests to URLs you configure, records the results, emails you when a monitor changes state, and optionally publishes uptime summaries on a public status page at a slug you claim. That's the whole product. Check frequency and monitor count depend on your plan.
We may change, add, or remove features over time. If we remove something you rely on, or make a change that materially reduces what your plan includes, we'll email account holders first.
## your account
You must be at least 18 and able to enter a contract. Sign-in is by magic link, so keep control of your email address — anyone who can read your inbox can sign in as you. One account per person or organization; don't share credentials. Tell us at support@its200.com if you believe your account has been accessed by someone else.
You're responsible for everything done under your account, including monitors created and status pages published.
## what you may monitor
This one matters, because you're pointing our servers at other people's machines.
- You represent that you own each URL you monitor, or are authorized by its owner to have it checked on this schedule. You authorize us to make requests to those URLs on your behalf.
- Don't use the Service to probe, scan, load-test, or otherwise generate traffic against systems you don't control — including using many monitors, or a short interval, to amplify request volume at a single target.
- Don't use it for anything unlawful, to infringe anyone's rights, or to publish content on a status page that is illegal, deceptive, or impersonates another company or service.
- Don't attempt to break, overload, reverse-engineer, or gain unauthorized access to the Service or the accounts of other users.
We may check URLs you submit against safety rules and refuse or stop checking any URL at our discretion.
## your content
Monitor names, URLs, status page titles, and logos stay yours. You give us only the permission needed to run the Service: to store that content, make the requests it describes, and display the parts you mark public on your status page. Checked URLs are never shown on status pages. What we collect and how long we keep it is set out in our privacy policy.
## plans, billing & refunds
Paid plans are billed monthly in advance through Stripe and renew automatically until cancelled. Prices are in US dollars and exclude any taxes you may owe. If we change the price of your plan, we'll email you before it takes effect, and you can cancel instead.
Cancelling stops future charges; paid features run until the end of the period you already paid for. If a payment fails or a subscription lapses, your account drops to the free plan and its limits — including its monitor count and minimum check interval — apply.
Refunds are covered by our refund policy: 30 days, no questions asked.
## suspension & termination
You can stop using the Service at any time and delete your account by emailing support@its200.com. We may suspend or terminate an account that breaks these terms, that we reasonably believe is being used to harm a third party or the Service, or that we're required to act on by law. Where it's reasonable to do so, we'll warn you first and give you a chance to fix it. If we terminate your account without cause, we'll refund the unused portion of your current billing period.
On termination, monitoring stops, your status page stops resolving, and your data is deleted on the schedule in the privacy policy.
## no warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
In plain terms, we do not promise that:
- the Service will be available, uninterrupted, or error-free — there is no SLA, and monitoring itself can go down;
- every check will run exactly on schedule, or that a check result accurately reflects what your users experience from their own networks;
- an alert will be generated, delivered, or delivered promptly — email can be delayed, filtered, or dropped by systems outside our control;
- we will never report a false alarm, or miss an outage entirely.
Do not use its200 as the only mechanism protecting anything where a missed or late alert would cause serious harm — including systems involving personal safety, medical care, financial settlement, or regulatory deadlines. It is a convenience tool, not a safety control.
## limitation of liability
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service — under contract, tort (including negligence), statute, or any other theory — will not exceed the total fees you actually paid us for the Service in the one (1) month immediately preceding the event giving rise to the claim. On the free plan, and in any month for which you paid nothing, that amount is $0.
We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, lost data, reputational harm, or the cost of substitute services — including any loss arising from downtime we failed to detect, an alert that was not sent or not received, a delayed or inaccurate check, or an incorrect status page. This applies even if we were advised such damages were possible, and even if a limited remedy fails of its essential purpose.
These limits are a fundamental part of the deal: the price of the Service reflects them, and we could not offer it at this price without them.
Nothing here excludes liability that cannot be excluded by law, such as liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability a governing law makes non-waivable. Some jurisdictions don't allow certain exclusions or limits, so parts of this section may not apply to you; the rest still does, to the fullest extent allowed.
## indemnity
You'll defend and indemnify us against claims, damages, and reasonable costs (including legal fees) brought by a third party and arising from your use of the Service in breach of these terms — particularly claims that you had monitors pointed at systems you weren't authorized to check, or that your status page content infringed someone's rights.
## changes to these terms
We may update these terms. If a change materially affects your rights, we'll email account holders at least 14 days before it takes effect, and continuing to use the Service after that date means you accept the new version. The "last-modified" date at the top of this page always reflects the current version.
## governing law
These terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules, and you and we agree to the exclusive jurisdiction of the state and federal courts located there. If any provision is found unenforceable, it's narrowed to the minimum extent needed and the rest stays in force. Our failure to enforce a provision isn't a waiver of it.
These terms, together with the privacy policy and refund policy, are the entire agreement between us about the Service.
